1. Who We Are

West Texas AI is a one-person AI agency operated by Cody McMurray, based in West Texas. Our website is westtexas.ai. You can reach us at cody@westtexas.ai. By using this website or engaging our services, you agree to these Terms of Service.

2. Services

West Texas AI builds custom AI systems for small and mid-size businesses. Services include AI workflow automation, voice AI phone systems, lead response systems, scheduling automation, invoicing automation, and generative engine optimization (GEO). All services are delivered under a separate written agreement or statement of work signed by both parties.

Information on this website is for general informational purposes. Nothing on this site constitutes a binding offer or guarantee of specific results.

3. SMS Messaging and Communications

By providing your phone number on this website, you consent to receive text messages from West Texas AI related to your inquiry, service updates, and follow-up communications.

• Message frequency: Message frequency varies based on your inquiry. You may receive up to 4 messages per month.
• Message and data rates may apply. Standard carrier message and data rates apply to all SMS communications.
• Opt out: Reply STOP at any time to unsubscribe from SMS messages. After opting out, you will receive one final confirmation message and no further SMS communications will be sent.
• Help: Reply HELP for help or contact us at cody@westtexas.ai.
• No third-party sharing: Your mobile phone number will not be shared with third parties for marketing purposes.
• Supported carriers: All major US carriers are supported. Carrier support is not guaranteed for all mobile operators.

4. Voice AI and Automated Calling

West Texas AI builds and deploys AI voice systems for client businesses. If you receive a call from a business using West Texas AI-powered voice technology, that call may be handled by an AI voice agent. Calls may be recorded for quality and training purposes. If you do not wish to speak with an AI system, you may request to speak with a human representative at any time or end the call.

All voice AI systems built by West Texas AI comply with the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations. Clients who deploy voice AI systems through West Texas AI are responsible for their own compliance obligations toward their end users.

5. Email Communications

By submitting your email address on this website, you consent to receive transactional emails including your AI report or score results, follow-up communications related to your inquiry, and service-related notifications. You may unsubscribe from follow-up emails at any time by clicking the unsubscribe link in any email or emailing cody@westtexas.ai.

6. Payment Terms

All pricing shown on this website is in US dollars and represents starting prices. Final project pricing is confirmed in a written proposal before any work begins. One-time build fees are invoiced prior to project start or per the agreed payment schedule. Monthly retainer fees are invoiced at the beginning of each month. Payments are processed via Stripe. All payments are non-refundable except as outlined in the applicable project agreement.

7. Intellectual Property

Upon full payment, clients own the custom code, workflows, and AI systems built for them by West Texas AI. West Texas AI retains the right to use general techniques, methodologies, and non-proprietary components in other projects. The West Texas AI name, logo, and website content are owned by Cody McMurray and may not be reproduced without permission.

8. Disclaimer of Warranties

Services are provided "as is" without warranty of any kind. West Texas AI does not guarantee specific business outcomes, lead volumes, revenue increases, or call conversion rates. AI systems are subject to the limitations of underlying third-party models and platforms. West Texas AI is not responsible for downtime or changes made by third-party providers including but not limited to Retell AI, OpenAI, Anthropic, Twilio, and Make.

9. Limitation of Liability

West Texas AI shall not be liable for indirect, incidental, or consequential damages arising from use of any service or AI system. Total liability for any claim shall not exceed the amount paid by the client in the 30 days preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Texas. You agree to waive the right to a jury trial for any dispute arising under these Terms.

11. Changes to These Terms

West Texas AI may update these Terms at any time. The updated version will be posted at westtexas.ai/terms with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
